When transiting the Gulf of Guinea, it is critical that ship-owners and charterers firmly understand the following vital information when considering the use of armed security: It is illegal for Private Maritime Security Companies to carry firearms in any of the West African territorial waters, Nigeria, (Lagos & Port Harcourt), Togo, (Lome), Benin, (Cotonou) and Ghana, (Accra & Tema). It is also illegal for Private Maritime Security Companies to transit firearms through any of these countries.

Any armed security personnel inside of these countries’ territorial waters must be serving members of the National Armed Forces. The National Armed Forces of the respective countries will not carry insurance for their personnel on-board commercial shipping tasks, LGS take this responsibility instead and ensure that all personnel operate professionally and efficiently in order to mitigate any risks.

LGS have established procedures to enable both company personnel or any other third parties to report any potential violations of the International Code of Conduct (ICoC), or company policies. As a certified member of ICoCA, we encourage grievances to be registered via the 24/7 HR Hotline by telephoning:
+44 (0) 7432 349305, or by emailing human.resources@lgs.global. Calls and emails are strictly confidential, and every reasonable effort will be made to protect the identity of the complainant.

LGS endeavour to:

  • Acknowledge complaints within 5 working days;

  • Establish procedures for our personnel and third parties to report allegations of improper and/or illegal conduct to designated personnel, including such acts or omissions that would violate the principles contained in this Code. Procedures must be fair, accessible and offer effective remedies, including recommendations for the prevention of reoccurrence. They shalI also facilitate reporting by persons with reason to believe that improper or illegal conduct, or a violation of this Code has occurred or is about to occur of such conduct, to designated individuals within a Company and where appropriate, competent authorities;

  • investigate allegations promptly, impartially and with due consideration to confidentiality;

  • Keep records about any such allegations, findings or disciplinary measures. Except where prohibited or protected by applicable law, such records should be made available to a Competent Authority on request;

  • Cooperate with official investigations, and not participate in or tolerate from their personnel, the impeding of witnesses, testimony or investigations;

  • Take appropriate disciplinary action, which could include termination of employment in case of a finding of such violations or unlawful behaviour; and

  • Ensure that their personnel who report wrongdoings in good faith are provided protection against any retaliation for making such reports, such as shielding them from unwarranted or otherwise inappropriate disciplinary measures, and that matters raised are examined and acted upon without undue delay.

  • Should a person wish to submit a grievance appeal, this must be submitted within 5 days to enquiries@lgs.global

The LGS Ethics Code

The business philosophy of LGS has been developed around a core set of values which are fundamental to the organization development and success. One of these values is Integrity, which means we can always be trusted to do the right thing, and the LGS Ethics code below sets out how we expect all our employees to behave in order to live this core value.

All LGS department heads are required to ensure the LGS Ethics Code is cascaded throughout their business and brought to the attention of all employees. Each new employee will be trained by their line manager to familiarize themselves with this code.

The Business Ethics Policy

In support of this code, the purpose of this Business Ethics Statement is to ensure that managers and employees have a detailed understanding of the group minimum standard of operation and the expectations of our customers and board of Directors.

It is essential that the ethical business standards set out in this Statement are applied throughout our countries of operation. Our senior managers are therefore asked to show their personal commitment by regularly endorsing the full Business Ethics Policy and confirming compliance within their own areas of responsibility.

We are committed to these standards and routinely monitor compliance across the organisation, taking necessary action in the unlikely event that they are not being met.

LGS is an accredited member of the ICoCA and is committed to fulfilling its responsibilities on human rights by applying the United Nations Guiding Principles on Business and Human Rights (2011) across all of our business practices.

The Guiding Principles affirm four international standards that have achieved broad international consensus as a human rights baseline for all businesses:

    • The Universal Declaration of Human Rights (1947)

    • The International Covenant on Civil and Political Rights (1966)

    • The International Convention on Economic, Social and Cultural Rights (1966)

    • The International Labour Organisation Declaration on Fundamental Rights at Work (1998)

The main values of these guidelines are:

    • The state has the overall duty to set and enforce laws and practices that protect the human rights of its citizens and population within its jurisdiction.

    • Businesses have a responsibility to respect human rights in everything they do.

    • Good human rights due diligence is the best way for businesses to ensure that they prevent actual or potential human rights abuses and shape their businesses in such a way that they actively respect human rights.

    • States and businesses share a joint responsibility to ensure that people have appropriate and effective access to remedy from business related human rights violations.

    • In contexts where states fail to protect people’s human rights, wherever possible and whenever this does not put our staff at immediate risk or bring us into dangerous conflict with local legislation, businesses should operate beyond local law and custom by applying international standards.

 

These main UN principles are encapsulated by the term “protect, respect and remedy”. And we have adopted these Guidelines as the basis of human rights monitoring and reporting throughout LGS.
